My Consumer Bankruptcy Practice

The federal bankruptcy laws were enacted to provide relief for people facing severe financial challenges. Filing for bankruptcy protection puts an immediate end to harassing phone calls, letters and repossession attempts from creditors.

At my office, I help individuals file bankruptcy and stop the endless creditor harassment they are facing. Whether through Chapter 7 bankruptcy or Chapter 13, I will work to find the best option for you and your situation. I understand every bankruptcy is unique. I will sit down with you, carefully gather information about your specific situation and offer advice on the best route to take.

Chapter 7 Bankruptcy

Under the recent revisions to the bankruptcy laws, to qualify for the permanent discharge of debt under Chapter 7 bankruptcy, you must submit to a means test, demonstrating to the bankruptcy court that you lack the "means" to repay your creditors.

When you come to my office to explore your bankruptcy options, I will first determine if your situation passes the means test. If you qualify, I will carefully explain which debts can and cannot be discharged and which assets are protected. I will prepare and file all required documents, and submit them to the bankruptcy court and appear on your behalf in meetings with creditors and the trustee. I will also represent you in bankruptcy court proceedings, if need be.

Chapter 13 Bankruptcy Alternative

If you do not meet the eligibility requirements under Chapter 7, I will work with you to reorganize your debt under Chapter 13, helping you set up a payment plan to repay your creditors over a three- to five-year period. I will prepare and submit a reorganization plan, and will review any proposed repayment agreements from your creditors.

Bankruptcy Litigation

From time to time, certain issues in your bankruptcy case may find their way inside the courtroom. I have extensive experience litigating cases within the context of the bankruptcy laws. I have represented consumers and small businesses having legal disputes in bankruptcy since 1995. I am committed to exploring all options to find the best possible solutions for you.
